
Terms and Conditions
1. Scope, Contracting Parties
1. These General Terms and Conditions govern the conclusion, execution, and processing of contracts for participation in the course "High-Performance Coaching in Football – A Holistic Approach."
2. The contracting party is the course provider ("Organizer") (SKLSet Performance GmbH, Lindenstraße 57 b, 15732 Eichwalde, stephan@kerth-gamechanger.com, registered company details).
3. The course is primarily aimed at professional practitioners and coaches worldwide; participation by other interested parties is possible subject to availability.
4. The course language is generally English; supplementary German-language information or materials can be provided upon request.
2. Subject Matter of the Course
1. The course is designed as a modular, practice-oriented training program that addresses the essential dimensions of high-performance coaching in football using a holistic approach, including sports-specific, methodological, and organizational aspects. The organizer may flexibly determine the focus, sequence, methods, and formats within the framework of didactic and organizational requirements at their own discretion.
2. The course will be delivered primarily online in live sessions, supplemented by accompanying materials and—as needed—by assignments and practice-oriented reflection prompts for in-depth learning and application to participants' own work environments. The final session may be held in person, provided it is logistically feasible.
3. The content may be grouped into several modules, each containing multiple live online sessions. The holistic nature of the course is fostered through coordinated focus areas. The specific design of the modules, their sequence, and their respective scope will be determined at the organizer's own discretion, both didactically and organizationally.
4. Materials and supplementary learning content may be provided after sessions. Individual or group assignments may also be completed in virtual spaces and (if necessary) submitted for review, without any guarantee of a specific form of feedback or repetition.
3. The course content may be distributed after sessions. 5. The organizer may engage external experts from top-level European football on a case-by-case basis, provided this is appropriate in terms of content and organization; payment is handled by the organizer, without any guarantee of the presence of specific individuals or profiles.
6. Communication with the teaching team may take place to a reasonable extent via email or chat; response times depend on availability and will be communicated within the course framework, without any guarantee of binding response deadlines.
7. A mandatory in-person module at a suitable venue is planned at the end of the course, typically over a weekend (arrival Friday to departure Sunday), provided this is logistically feasible; deviations are possible, provided they do not contradict the overall character of the course. Additional activities such as stadium tours, sightseeing, or group restaurant visits may be planned depending on availability and suitability, without any guarantee of a specific format.
3. Booking, Contract Conclusion, Duration
1. Bookings are binding and made via the organizer's online platform; the contract is concluded upon completion of the booking process. After payment is received, a booking confirmation with essential course information (e.g., email/PDF) will be sent.
2. Before submitting your order, you will be provided with the terms and conditions and must actively check the box to accept them.
3. Participants must keep their login credentials confidential; access is personalized and non-transferable. The organizer may block access and request clarification in case of suspected misuse.
4. The contract terminates upon completion of the booked course; the right to extraordinary termination for good cause remains unaffected.
4. Prices, Taxes, Payment Terms
1. The total price is displayed before booking; VAT treatment is governed by statutory regulations. For B2B services to foreign businesses, special VAT regulations (e.g., reverse charge) may apply; suitable documentation (e.g., VAT ID) may be required.
2. Payments must be made in advance or via direct online payment. Payment in installments can be arranged, subject to availability and indication.
3. Payment is generally due immediately upon booking, unless installments have been agreed upon. In case of late payment, the organizer may withhold services, claim damages, and – after setting a deadline – withdraw from the contract.
4. Price changes due to external factors (e.g., taxes, fees, hotel/catering prices, exchange rates) are reserved for future price adjustments; for bookings already confirmed, the price changes remain valid.
The agreed prices apply, subject to the correction of obvious pricing errors.
5. Participation Requirements, Flexibility, Parallel Sessions
1. Attendance at the final session is mandatory; alternative make-up sessions are subject to organizational feasibility, without any legal entitlement to a specific substitute.
2. In case of illness, a one-time transfer to a parallel course within the same week may be permitted; from the second absence onward, participants are responsible for catching up on the missed material without any right to repeat the session. Participants are primarily responsible for catching up on missed content; participation in make-up sessions with other groups is only possible subject to availability and prior arrangement.
3. Group size per course cycle is limited to ensure capacity and quality; multiple parallel sessions at different times of the week may be offered to accommodate time zones and professional commitments. Adjustments, merging, or reassignments are possible to the extent reasonable and organizationally necessary.
4. Participants are responsible for ensuring they meet minimum technical requirements (e.g., a stable broadband connection, camera and microphone, and up-to-date browser/software). The organizer accepts no liability for cancellations or problems on the part of participants.
5. Transferring a booking to a substitute participant requires the prior consent of the organizer; there is no entitlement to such consent.
6. Learning Outcomes, Examinations, Certificate of Participation, and Certification
1. Examinations may be conducted in various formats (e.g., multiple choice, short case studies, reflection exercises, practical application); the scope and formats are determined at the organizer's discretion.
2. Upon successful completion of the course—including any required examinations and the in-person sessions—a private, manufacturer-specific certificate may be issued. This certificate serves as proof of participation and competence for third parties, but does not constitute a binding statement regarding external recognition. In particular, it does not qualify for the renewal of the DFB (German Football Association) coaching license.
7. Cancellation Policy for Consumers
Right of Withdrawal
Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform the organizer (SKLSet Performance GmbH, Lindenstraße 57 b, 15732 Eichwalde, stephan@kerth-gamechanger.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but this is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, the organizer shall reimburse all payments received from you without undue delay and in any event no later than 14 days from the day on which the organizer receives your notification of withdrawal from this contract.
For this reimbursement, the organizer will use the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
The right of withdrawal expires in the case of a contract for the provision of services if the trader has fully performed the service and only began performing the service after the consumer gave their express consent and simultaneously confirmed their awareness that they would lose their right of withdrawal upon complete performance of the contract by the trader.

8. Changes to the Course Schedule, Adjustments to Performance, Cancellation Policy
1. Changes, additions, and updates to the schedule, content, order, methodology, speakers, teaching methods, and scheduling are reserved for organizational, didactic, or legal reasons, provided that the overall character of the course is not significantly affected.
2. The organizer may replace instructors with equivalent experts and provide parts of the service in a functionally equivalent manner online, in a hybrid format, or in person, insofar as this is reasonable and objectively justified.
3. In the event of cancellation or postponement of individual sessions for reasons attributable to the organizer, appropriate alternative services or dates will be offered.
4. Force majeure, official orders, epidemics/pandemics, security situations, strikes, failure of critical infrastructure, travel/visa restrictions, or events affecting third-party providers (hotel, stadium, caterer, platform) entitle the organizer to adjust, postpone, digitize, or replace components of the service with equivalent alternatives.
5. Minimum and maximum participant numbers, group composition, and parallel sessions may be adjusted; the organizer may combine groups or assign participants to parallel sessions, insofar as this is reasonable.
9. Cancellation/Rebooking
1. Cancellation after the withdrawal period has expired is not possible; the organizer will decide on rebooking at their reasonable discretion.
2. In the event of a demonstrably denied visa or unforeseen entry obstacles for the in-person phase, the organizer may, at its sole discretion, offer rescheduling to a later session or an alternative format.
3. Any third-party costs (e.g., no-show, rebooking, or cancellation fees for hotels/transportation) are the responsibility of the participant if they are at fault or fail to report obstacles in a timely manner.
4. Statutory rights of withdrawal remain unaffected.
10. Code of Conduct, House Rules, Copyright and Usage Rights
1. Participants agree to respectful communication, respect for personal rights, confidentiality, and adherence to netiquette. For in-person events, the venue's house rules and safety regulations also apply; instructions from staff must be followed.
2. Without the prior express consent of the organizer, taking photographs, audio recordings, or videos of the course, as well as distributing course materials to third parties, is prohibited. The organizer is entitled to block access and claim damages in the event of violations; further claims remain unaffected.
3. The course may be recorded for internal documentation, quality assurance, and course organization purposes. Participants will be informed of this in advance and may object to the processing of their data for reasons arising from their particular situation (Art. 21 GDPR). In the event of an objection, the individuals concerned will be anonymized in the recordings where possible and will not be published.
The use of images, audio, and video recordings of participants for public relations, marketing, advertising, or publication (e.g., website, social media, print) is only permitted with separately granted, voluntary, and revocable consent. Participation in the course is not contingent upon this consent.

4. All course content (documents, presentations, videos, assignments, tools) is protected by copyright and intended solely for the personal use of the participant. Reproduction, distribution, or making it publicly available outside the contractual purposes is prohibited.
The granted usage rights are simple, non-transferable, and non-sublicensable. They apply for the duration of the course and a reasonable follow-up period and exclude third-party use unless expressly authorized.
5. Participants grant the organizer a simple, non-exclusive right to use their contributions (e.g., questions, contributions, presentations) included in recordings for the purpose of conducting the course and—if marketing consent has been given—for external communication to the extent covered by that consent. This transfer of rights is free of charge. Participants are responsible for safeguarding the rights of third parties.
11. Liability, Data Protection
1. The organizer assumes no liability for failures or technical problems on the participant's side (e.g., end devices, internet, firewalls).
2. Otherwise, the organizer is liable without limitation in cases of intent and gross negligence, as well as for damages resulting from injury to life, body, or health. In cases of simple negligence, liability is limited to breaches of essential contractual obligations (cardinal obligations) and is further limited to the foreseeable damages typical for this type of contract. Mandatory liability provisions remain unaffected.
3. We are not liable for personal belongings brought to in-person events, except in cases of intent or gross negligence; the venue's terms and conditions also apply.
4. Health Notice: Coaching does not replace medical advice or treatment; participation is at your own risk.
5. Personal data is processed in accordance with the organizer's data protection regulations; details (categories, purposes, legal bases, recipients including service providers/speakers, transfers to third countries, storage period, data subject rights) can be found in the data protection declaration.
13. Third-Party Services, Miscellaneous
1. Travel arrangements, visas, entry formalities, and insurance (e.g., health or trip cancellation insurance) are the responsibility of the participants.
2. Dietary requirements or allergies must be communicated in a timely manner; a specific offer cannot be guaranteed.
3. Services provided by third parties (hotel, stadium, shuttle, caterer) are subject to their terms and conditions; changes to or restrictions in the services offered by these providers may necessitate adjustments to the program.
4. If external platforms/service providers are used for course delivery, their terms of use apply in addition. Information on any data transfers (including to third countries) is available.
14. Platform Availability, Dispute Resolution
1. The organizer strives for high availability; planned maintenance will be communicated in advance whenever possible. Safety-related interventions, emergency maintenance, or disruptions may lead to temporary restrictions without giving rise to any claims, provided the overall nature of the course remains intact.
2. The organizer is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
23. Final Provisions
1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the organizer's registered office, provided the participant is a merchant, a legal entity under public law, or a special fund under public law; for consumers, the statutory places of jurisdiction apply.
2. Severability Clause: Invalid provisions shall be replaced by provisions that most closely approximate the intended economic purpose. By booking, the participant accepts these terms and conditions and the general terms and conditions.
